The above Described dog hereby known as said animal has been purchased
from the Litter Owner under
this agreement of Co-Ownership so that said animal is eligible for full
registration with the American
Kennel Club.
The purpose of this agreement is to:
1. Ensure that said animal lives a safe, healthful, active, high
quality life.
2. To espouse the Brittany Dual Concept and assure that said animal
receives reasonable maximum
exposure to AKC show and field events.
3. To improve the Brittany breed.
4. To clearly define the duties and obligations of all Co-Owners and to
promote good will and cooperation between all Co-Owners.
Primary Owner Terms:
1. The Primary Owner (care giver) will maintain said animal at their
residence and will be responsible for
proper care, nutritional needs, all veterinarian care- such as
shots/timely check-ups, and any other care
needed for the good health of said animal. It is also agreed that
said animal will not be left unattended for prolonged periods of time.
2. The Primary Owner (care giver) agrees to raise said animal in an
environment of love and attention. Said animal will be handled in
such a way that instills trust of people.
3. The Primary Owner (care giver) agrees to train said animal for: 1)
hunting, 2) conformation show ring, and 3) for field events (field
trials and/or hunt tests) once all vaccinations are up to date.
The primary Owner (care giver) also agrees to train, condition, groom
and feed as a show and [field trial or hunt test] prospect - including
being broke, fetching and backing.
4. The Primary Owner (care giver) agrees to closely monitor the
condition of said animal’s diet, coat and skin, attitude and overall
health.
5. The Primary Owner (care giver) will determine which shows and field
events will be best suited for said animal. All costs and fees
are the responsibility of the Primary Owner (care giver) while said
animal resides with the Primary Owner. Any Advertising is to be
agreed upon by all the owners, and cost will be decided upon at such
time. All show photos of major wins shall be paid for by Primary Owner
(care giver) and a digital copy sent to Co-Owners/Third Party
Co-Owner(s), if requested.
6. Copies of title certificates, OFA evaluations, microchip information
and any other competition, health, registration or identification
papers must be sent to all Co-Owners.
7. The Primary owner will keep a written and electronic record of all
competitions entered and their outcome. They will provide this to
Co-Owners upon request. Co-Owners must contribute to this record
when they have/handle said animal.
The following items must be accomplished prior to breeding said animal:
1. Said animal must be 2 years of age.
2. Said animal must show at least ordinary Brittany hunting ability and
have a good temperament as judged by Primary Owner and Co-Owner.
3. Said animal must be clear of Hip Dysplasia by the OFA (Orthopedic
Foundation for Animals) and have an OFA rating of Good or
Excellent. Front elbows must be normal. Test results of
hips and elbows must be provided to Primary Owner, Co-Owner and Third
Party Co-Owner(s).
4. Said animal must complete their AKC Show Championship and have at
least earned two (2) field trial points and/or an AKC Junior Hunter
hunt test certification (preferably Senior Hunter or Master Hunter).
Breeding Said Animal
1. The Breeder has the right to reserve first breeding if said animal
is a female. If said animal is a male, the Breeder and Third
Party Co-Owner(s) may use the dog as a stud [for their breeding program
only] at no cost, at any reasonable time. It is the
responsibility of the Co-Owner or Third Party Co-Owner(s) involved in
the above mentioned breeding(s) to pay for transport of said animal,
stud dog or bitch being bred. All bitches involved must have
current negative brucellosis test and be OFA (hip and elbow) certified.
2. All Co-Owners have the right to three (3) successful semen
collections from said animal. These will be done at their own
expense at any time after 2 yrs. of age, to use as they see fit,
following AKC and ABC guidelines.
It is further agreed:
1. During the life of said animal, Primary Owner, Co-Owner and Third
Party Co-Owner(s) agree to notify each other of any changes of:
address, E-mail, Web Site, and/or telephone numbers. When said animal
resides with Co-Owner or Third Party Co-Owners(s), the party where said
animal resides is responsible for proper care, nutritional needs,
record keeping, all veterinarian care- such as shots/timely check-ups,
and any other care needed for the good health of said animal. It
is also agreed that said animal will not be left unattended for
prolonged periods of time.
2. When transporting said
animal from
one Co-Owner to another for non-breeding purposes, transport costs will
be shared equally between the two parties involved in the
transfer.
3. When said animal resides with
Co-Owner or Third Party Co-Owners(s), the party where said animal
resides is responsible for paying for all competition fees and
expenses. Specific written agreements between any Co-Owners may
supercede this stipulation.
4. If any Co-Owner (Primary Owner, Co-Owner, or Third Party Co-Owner)
abuses or neglects said
animal, they forfeit all rights of Co-Ownership to said animal.
Said animal shall be immediately returned to the other Co-Owners.
If said animal is not immediately returned to the other Co-Owners, the
other Co-Owners have the right and responsibility to inform the
Brittany/dog community of said abuses or neglects and to take
full legal action to secure the safety and ownership of said animal.
5. All Co-Owners will follow all the AKC and American Brittany Club
Code of Ethics that pertain to said animal and said animals offspring.
6. The Primary Owner has the responsibility of being the life time
owner/care giver of said animal. The Co-Owners and Third Party
Co-Owner may relinquish their ownership rights at any time in writing
and, will help expedite the paperwork involved.
7. If said animal is not working out as a competition dog, all the
Co-Owners may agree in writing to have said animal spay/neutered and
sold to a pet home. Proceeds of this sale shall be split equally
between all Co-Owners.
8. Breeder always reserves the right of first buy-back.
